Samsung may have lost its patent suit against Apple, but the Korean consumer electronics powerhouse has some reason celebrate. The company's new top-tier smartphone, the Galaxy S3 has surpassed the iPhone 4S for the first time as the best-selling smartphone in the U.S, reports CNET

CNET got its figures from analyst T. Michael Walkley from Canaccord Genuity, who "checks in with retailers to see how each phone is doing." According to Walkley, the iPhone 4s, which has reigned supreme as the top-selling smartphone since its October release, was finally overtaken by the Galaxy S3 in the month of August.

The drop in numbers can be attributed to a number of things, but is more than likely a sign that people are waiting for Apple to introduce the iPhone 5 next week before making a decision on which phone to buy. Still, Samsung's success is not all due to Apple's failure. Other smartphone brands such as HTC and Nokia saw little to no uptick in sales.
