A stop-and-frisk that reportedly erupted into a violent beating in the Bronx last month is under investigation.

According to ABC New York, Santiago Hernandez, 23, was waiting for a friend on a Bronx street on Aug. 18 when an officer asked to search him. When the search yielded nothing, Santiago says he asked the officer—who the outlet says was responding to a noise complaint in the neighborhood—why he had been stopped. That's when the officer proceeded to handcuff him.

"I'm like, 'Miss what you doing? You are hurting my arm,'" he told ABC News York.

The video then shows another six or so officers arriving and attacking Santiago, who said he was "punched, kicked, beaten with nightsticks, and blasted with pepper spray." Though he was charged with resisting arrest and disorderly conduct, he was not prosecuted

Hernandez's attorneys plan to file a civil suit on his behalf, and an Internal Affairs investigation is being conducted as well.
