Judge Tells First-Time Offender He "Would Probably Be Raped Every Day" in Jail

The offender ultimately got a five-year probation sentence.

Bernalillo County Judge Christina Argyres, reportedly facing pressure from various officials in New Mexico to "get tougher" on crime, told a first-time offender this week that he "would probably be raped every day" in jail. Argyres, who KOB 4 says is still facing harsh criticism for allowing an accused murderer out on pretrial release with no bond earlier this year, ultimately slapped this particular offender with a five-year probation sentence.

Isaiah Gay was charged with burglarizing homes with a group of friends when he was 18 years old, his first offense. "I did the things I did all because I was impulsive," Gay told Argyres during the ruling, according to court documents obtained by KOB 4. "I was just being young and dumb." The "young and dumb" argument didn’t go over well with Argyres, who doubled down on her "probably raped every day" sentiment with this:

"I hate to sound like that, you know – rude, but that's exactly what would happen to you."

Though Gay ultimately avoided jail time with the aforementioned probation sentencing, Judge Argyres was quick to reinforce the fact that 15 years of lock-up would most certainly be hanging over his head during his probation period. "I'm willing to give you a chance," Judge Argyres told the young offender. "You blow it, it's on you, not me. Fair enough?"
