The woman who filed a lawsuit against Derrick Rose accusing him and two other men of breaking into her apartment and raping her is also pursuing criminal charges, according to TMZ. She has filed a police report with the Los Angeles Police Department.

TMZ spoke with one of the woman’s attorneys, Brandon Anand, who said there is a reason criminal charges were filed just days after the civil ones. Anand said the statute of limitations on civil suits was winding down, and his client attempted to reach a settlement with Rose before taking legal action, but Rose “didn’t acknowledge any wrongdoing.”

The woman filed the civil suit in Aug. 2015 for an incident that allegedly happened in 2013. She says she was partying at Rose’s house in Beverly Hills earlier that night. She is seeking more than $20 million in damages.

The Knicks point guard says he and the woman had sex that night, but it was consensual, and her narrative is “completely false.” Rose’s representatives say he and the woman were in a relationship for 20 months, and “the plaintiff consented to sex each and every time they had sex.”

According to the Huffington Post, Rose could not define “consent” when he was asked to do so during a deposition.

“The question was, ‘Do you have an understanding as to the word consent?’” said Waukeen McCoy, another of the accuser’s attorneys. “The answer: ‘No, but can you tell me?’ The questioner: ‘I just wanted to know if you had an understanding.’ The answer: ‘No.’”

While the criminal investigation commences, the civil trial should get underway soon. It is set to begin in October, but the accuser reportedly wants to settle the case outside of court.
